Legal framework

Residence in Brazil is governed by the Migration Law (Lei 13.445/2017) and Decreto 9.199/2017. Authorisations are granted for a fixed or indefinite term depending on the ground; registration with Policia Federal produces the CRNM and Receita Federal issues the CPF.

Main routes

  • Investment in a Brazilian company: Resolucao Normativa CNIg 13/2017 — R$ 500,000, or R$ 150,000 for innovation, research and technology projects; residence for an indefinite term.
  • Real estate: Resolucao Normativa CNIg 36/2018 — R$ 1,000,000 urban property, R$ 700,000 in the North and Northeast; fixed-term residence first.
  • Company administration, family reunification (Lei 13.445/2017, art. 37), study and employment.

Naturalisation timelines set by statute

  • Ordinary naturalisation: four years of residence, civil capacity, ability to communicate in Portuguese, no final criminal conviction (art. 65).
  • Reduced to one year with a Brazilian spouse or partner or a Brazilian child, among the cases in art. 66.
  • Extraordinary naturalisation after more than fifteen years of uninterrupted residence (art. 67).
  • The count runs on residence, not on the investment date; the often-quoted figure of eight years does not appear in the statute.
